Professor
Gary T. Amos is a former law professor at Regent
University and the author of Never Before in
History and Defending the Declaration, two books
that document the influence of Christianity on the
American Founding.
Prof.
Amos has written a fantastic essay that answers
this question:
"Does
the Constitution protect the substantive rights to
life, liberty, and property set forth as
unalienable rights in the Declaration of
Independence?"
The
essay traces the attempt to provide protection for
these unalienable rights starting with provisions
America's Founders included in the Northwest
Ordinance and continuing through the Missouri
Compromise, the U.S. Supreme Court case of Dred
Scott that launched the Civil War, the declarations
of Confederate States in their Seccession Decrees
and the statements of the Congress that drafted and
passed the 14th Amendment.
This
is fascinating history that is not taught anywhere
- not even in law schools.
Prof.
Amos shows irrefutably that the 14th Amendment was
carefully drafted to overturn the Supreme Court's
holdings in Dred Scott and create federal
protection for the rights stated in the Declaration
of Independence.
The
essay concludes with an examination of case law
since the 14th Amendment was ratified to explain
why the state and federal judges that reviewed the
Schiavo case failed to follow - or even understand
- the applicable law.
